Terms and Conditions of Sale


Preamble

These terms are entered into between, on the one hand, SASU EASYCUT (RCS 990 032 187), 4 Allée des Chamoix, 38250 Villard-de-Lans, and, on the other hand, individuals wishing to make a purchase via the Stomie.fr website, hereinafter referred to as the “user.” The parties agree that the terms in force on the date of purchase exclusively govern their relationship. If a condition is missing, it shall be deemed governed by the practices applicable to the distance-selling sector.

Purpose

These terms define the conditions of sale between SASU EASYCUT and the user—from order placement to after-sales service, including payment and delivery. They apply exclusively to natural persons acting as consumers (non-professionals).

Orders

The user may place orders online:

from the online catalog; or

directly using references from printed catalogs.

An order can only be recorded on the site if the user has clearly identified themselves by entering their customer number (or web-specific login) and password, which are strictly personal. Any order implies acceptance of the prices and descriptions of the products available for sale. Any dispute on this point will be handled, where applicable, via an exchange and under the warranties described below.

The user may modify their cart before final validation; this final step formalizes the sales contract between Easycut and the user.

Easycut undertakes to fulfill orders received via the website within the limits of available stock, with an 8-week lead time. If a product is unavailable, the Company undertakes to inform the user.

In certain cases—particularly non-payment, an incorrect address, or another account issue—Easycut reserves the right to block the order until the problem is resolved.

Delivery

Shipments can be made within France, Monaco, the French overseas departments and territories (DOM-TOM), and European countries. Please refer to the “Delivery” section in the Services area for shipping methods and costs.

The instrument ordered will be shipped after payment. In light of manufacturing times, the delivery period is a maximum of 8 weeks.

Prices

Prices are shown in euros, all taxes included. They take into account the VAT applicable on the order date. Any change in the applicable rate may be reflected in product prices. However, once the customer’s order has been validated, prices cannot be changed.

If one or more taxes or contributions (including environmental taxes) are created or modified, whether up or down, this change may be reflected in the sale price of items shown on the Le Pas de la Fenêtre website and sales documents. Prices shown on the site are guaranteed for as long as they are online and within the limits of available stock. Prices of items ordered from the site based on catalog references (general or specialized) are governed by the catalog from which they are taken and the date indicated on that catalog.

Warranties

All items are covered by the statutory warranty of conformity provided for by the French Consumer Code and by a warranty against hidden defects (Articles 1641 et seq. of the French Civil Code), allowing the return of defective items.

Except where the legal warranty applies, any transaction between Easycut and users that is not contested within fifteen (15) days cannot give rise to a claim. Certain items also carry a contractual warranty in addition to the legal warranty. For example, Easycut cutting instruments are warranted for two years.

Legal references (informative translation):

Article L211-4, Consumer Code: The seller must deliver goods in conformity with the contract and is liable for any lack of conformity existing at delivery. They are also liable for any lack of conformity resulting from packaging, assembly instructions, or installation when these are their responsibility.

Article L211-5, Consumer Code: To conform to the contract, goods must:
1° Be fit for the usual purpose of similar goods and, where applicable:
– correspond to the description given by the seller and possess the qualities presented to the buyer as a sample or model;
– have the qualities that a buyer can legitimately expect given public statements by the seller, producer, or representative, notably in advertising or labeling;
2° Or have the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, made known to the seller and accepted by them.

Article L211-12, Consumer Code: Actions resulting from lack of conformity are time-barred two years from delivery.

Article 1641, Civil Code: The seller is liable for hidden defects that render the item unfit for its intended use, or that so diminish its use that the buyer would not have acquired it, or would have paid a lower price, had they known.

Article 1648 para. 1, Civil Code: Actions based on redhibitory defects must be brought within two years of discovery of the defect.

Signature and Proof

In all cases, entering a bank card number online and the final validation of the order constitute proof of the entirety of said order under the law of 13 March 2000, and constitute the sums due for the items entered on the order form. This validation serves as a signature and express acceptance of all operations performed on the site.

In the event of fraudulent use of the customer’s bank card, the customer is invited to contact easycut.stomie@gmail.com
 as soon as such use is detected.

Liability

Easycut is responsible for all stages from order taking through to post-contract performance and undertakes to describe the products sold on its website with the greatest accuracy. However, Easycut cannot be held liable if the non-performance of its obligations is due to the unforeseeable and insurmountable act of a third party to the contract, or to force majeure as defined by French case law. Nor can it be held liable for inconveniences or damages inherent in the use of the Internet, notably service interruption, external intrusion, or the presence of computer viruses.

Personal Data

The Company reserves the right to collect data on the user, notably through cookies. Data collection by Easycut, as data controller, is necessary to process the user’s requests. We are responsible for ensuring that the personal data we hold are correct and up to date and, in accordance with Article 32 of Law no. 2004-801 of 6 August 2004 amending Law no. 78-17 of 6 January 1978 (Data Protection Act), users have rights of access, rectification, and deletion of their personal data, which may be exercised at any time with Easycut, including directly online in My Account / Edit my personal details.

Easycut implements all means to ensure the confidentiality and security of data transmitted on the web. As such, the website uses a secure payment mode of the SSL (Secure Socket Layer) type.

Intellectual Property

All elements of the Stomie.fr website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks, or patents. Consequently, no document from the site may be copied, reproduced, republished, downloaded, posted, transmitted, or distributed in any way, except under the following conditions: one copy may be downloaded to a computer for personal, non-commercial use, provided the information is not modified and all copyrights and other proprietary notices are kept intact. Any modification of these documents or use for another purpose constitutes an infringement of the intellectual property rights of SASU EASYCUT.

A user who has a personal website and wishes, for personal use, to place on their site a simple link pointing directly to the homepage of the Le Pas de la Fenêtre site must first request authorization from the above-named company. This shall not constitute, under any circumstances, an implicit affiliation agreement. Any hyperlink to the site using framing or in-line linking techniques is strictly prohibited. In all cases, any link must be removed upon simple request from the company.

The trademarks, logos, designs, and models displayed on this site are the exclusive property of the respective brands. Their disclosure may not be interpreted as granting any license or right to use said trademarks and distinctive elements protected by copyright. Any such use may constitute infringement.

Entire Agreement

If any clause of this contract is rendered null and void due to a change in legislation or regulations, or by a court decision, this shall not affect the validity and enforceability of these terms and conditions.

Term

These terms apply for the entire period during which the services offered by the company Le Pas de la Fenêtre are online.

Evidence, Retention and Archiving of Transactions

Computerized records kept in the company’s and its partners’ IT systems under reasonable security conditions will be considered proof of communications, orders, and payments between the parties. Order forms and invoices are archived on a reliable and durable medium so as to constitute a true and lasting copy in accordance with Article 1348 of the French Civil Code.

Governing Law and Jurisdiction

These terms are governed by French law. In the event of a dispute, the Judicial Court of Grenoble shall have jurisdiction.

This site complies with French legislation, and SASU Easycut gives no warranty of compliance with any local legislation that may apply to you if you access the site from other countries.
